However, court approval is required where there has been two (2) prior instances of non-compliance with court-ordered discovery deadlines for the specific discovery at issue. If all discovery is complete but the deadline to file the note of issue has passed, the parties may submit a stipulation to extend the note of issue deadline to the chambers to be so-ordered.
