NY-SC-1JD-COHEN-P58-002 90 NY-SC-1JD-COHEN 2 – Motion Practice Motion Practice Requirements Oral Arguments of motions are held on Tuesdays beginning at 9:30 a.m., or as otherwise directed. Failure to appear for oral argument at the directed time may result in a default. All summary judgment motions must be filed within 120 days after the filing of the note of issue, unless otherwise ordered by the court. All summary judgment motions must contain a 'short and concise statement, in numbered paragraphs, of the material facts as to which the moving party contends there is no genuine issue to be tried' pursuant to 22 NYCRR 202.8-g(a). Part 58 is a paperless part and parties are not required to provide working copies of motion papers.
