BROGE-003 Part Rules – Hon. Brett Broge, J.S.C. 122 NY-SC-9JD-BROGE II-C-F Discovery, Settlement, and Adjournment of Conferences Discovery disputes: addressed between parties prior to Compliance Conference per Rule 202.20. If unable to resolve after good faith effort, contact Part Clerk for scheduling conference; conference required before filing discovery motion. Further conferences as directed by Court. Settlement conference held no less than one month prior to scheduled trial date; counsel attending must be fully familiar and authorized for settlement. No less than 7 days prior to settlement conference, plaintiff submits copies of all bills of particulars; each party submits letter on position. Adjournment of conferences: requests by letter filed to NYSCEF (e-filed) or emailed to Part Clerk and all counsel (paper); must be received no later than 24 hours prior; must state reason, consent/objection, at least 3 mutually-agreeable dates not less than 2 weeks after scheduled date.
