NY-SC-9JD-SHAKO-005 Part Rules and Calendar Procedure of Hon. Verris B. Shako 170 NY-SC-9JD-SHAKO V.SJ Summary Judgment Motions Summary judgment motions shall be filed with the Court and served upon all other parties no later than sixty (60) days after the filing of the Note of Issue. The Court requires the filing of a separate Statement of Material Facts, which shall lay out all relevant and material facts in enumerated form, with the admissible evidence supporting the fact cited. The non-moving party shall file a response to same in accordance with the Court Rules. This rule must be strictly adhered to.
