Papers not filed by noon on return date may not be considered. Oral argument may be requested on first page of Notice of Motion/OSC/answering papers; Court determines whether appropriate. MURPHY-003 Individual Part Rules – Hon. Alexandra D. Murphy 116 NY-SC-9JD-MURPHY III Trial Practice Rules Prior to hearing or trial, counsel must ascertain availability of witnesses and subpoenaed documents. Upon assignment, counsel must report to Part Clerk and provide marked pleadings and exhibits. Exhibits must be pre-marked with court reporter. Pre-trial conference conducted by Court immediately before hearing. Transcript portions read as evidence-in-chief must be provided to Court and all parties in advance. Upon admission of exhibit, proponent must provide complete copy to Court. Jury charges must be submitted with PJI numbers; deviations require full text with legal precedents. Verdict sheet prepared jointly; if no agreement, each party submits proposed. Post-trial: parties must jointly submit transcript; each party submits post-trial memorandum. No recording of any virtual proceeding including video, photos, or screenshots. No individual may be physically present in same room as party or witness except counsel. Witness and counsel must be visible on screen while under oath. All electronic devices not used to communicate with Court must be on mute.
